This is not a photo of Joseph Smith. This image is not even the one that experts believe is a photo touched up image of the painting (the image supposedly taken in 1843 by Lucian Foster). This is clearly a drawing. At the very least you could use the image from Wikipedia, or even see the discussion at http://www.mormonapologetics.org/index.php?showtopic=31761 (see the ssecond page)
